1 Terminologies
1.1 “T&C” abbreviation of Terms and Conditions
1.2 “You, your, the user” implies any third person accessing this website for the purpose of obtaining information and/or services (this include registered members where applicable)
1.3 “DBS” The Disclosure and Barring Service. It was established in 2012 and carries out the functions previously undertaken by the Criminal Records Bureau (CRB)
1.4 “FirstPlus Care Limited, we, us, our site, this site, this website” means us, our company or website
1.5 “Their” the term may refer to a Care Home (client), a Care Worker/Nurse, or any third-parties depending on the context of the sentence, paragraph, or clause.
1.6 “Member” means any person who has registered and has account on our website and access to personalized content and pages on this website.
1.7 “Client” referred to Care Homes members of this platform who provide accommodation and care to individuals unable to look after themselves as well as nursing care assisting those with greater needs.
1.8 “Care Worker/Nurse” a person employed to support and supervise vulnerable, infirm, or disadvantaged people or persons under the care of the state/a person trained to care for the sick or infirm.
1.9 “NMC” abbreviation for Nurse and Midwife Council
2 Terms & Conditions and purpose of this website
2.1 This website hereby referred to as “FirstPlus Care Limited, we, us, our site, this site, this website”, along with any other conditions of use found on this site are the proprietary right of FirstPlus Care Limited. Access to this site implies compliance with the terms of use stated herein. If you do not agree with the Terms and Conditions, please refrain from using this website. Your continued use of our site indicate that you accept the terms and conditions and abide by them.
2.2 FirstPlus Care Limited is a Care Home and Care Workers/Nurse service provider registered in England and Wales with registration number 11757079. Our company contact email address is support@FirstPlusCare.co.uk
2.3 Correspondence with us can either be by e-mail or telephone number as provided hereby and on our contact page. If for any reason we need to contact you, we will do so either using your contact details (telephone, email, postal address), or through this website if you're a registered member. Any means suitable under the circumstances.
2.4 The purpose of this website is to serve as a platform offering services for Care Homes and Care Workers/Nurses. This website function as a marketplace for Care Homes to find independent contractors Care Workers/Nurses or for Care Workers/Nurses to find suitable opportunities to provide their services as independent contractors to Care Homes.
2.5 These T&C applies to users, Care Homes, and independent Care Workers/Nurse to the extent of their interaction with the platform of Care Hires Limited.
2.6 These T&C include our Privacy Policy and any other document referring to the terms of use.
2.7 If you access this website on behalf of a third party, a company, a partnership, or any other entity which you act as the sole representative; you hereby warrant that you have the legal right to act or enter into an agreement binding the third party, company, partnership, or any other entity in accordance with these T&C such that when referring to “Member or Membership”, “You” and “Your” and/or references to you or your account as well as any warranties, representations, or statements equally apply to the third party, company, partnership or other entity who therefore remain liable to the same as noted under these T&C.
2.8 Any user of this website agrees to use this website in the proper manner and in accordance to the accessibility offered referring to access to general information content available to any user and access to individual, personalized content available for registered members.
    •    Under no circumstances should the site be used in a manner to disrupt, restrict, or interfere the use of this website by other users.
    •    It is strictly forbidden to modify, delete, or misuse data available on this website which include third party data found on this website.
    •    It is prohibited to download, copy, or use for personal or commercial reasons any material of this website unless strictly mentioned and/or allowed in the context of obtaining information and/or services from this website. 3 Limitation of Liabilities
3.1 FirstPlus Care Limited does not provide any guarantees neither do we make any warranties expressed or implied of the accuracy of the materials contained in this website.
3.2 FirstPlus Care Limited does not warrant that the present website, its content or functions are error-free and completely secured without viruses, or other harmful elements. We are not liable for damages that may occur to your computer, laptop, smartphone, or any other devices you might use to access the present platform. This include, but is not limited to:
    •    The loss of revenue or income
    •    The loss of data
    •    The loss of business
    •    The loss of goodwill
    •    Indirect or consequential loss
    •    Any other type of loss or damages (including negligence) resulting due to the breach of any agreement, foreseeable or not.
3.3 It is the responsibility of each members to seek insurance coverage, should they find it necessary for coverage against any loss or damage they may incur as a result of the use of this website which include but is not limited to;
    •    their access to the platform
    •    their interaction with other member, third-parties, etc.
    •    any duties or contract
3.4 FirstPlus Care Limited liability is strictly limited to the insurance coverage arranged by us and/or applicable by law should there be any negligence on our part resulting in:
    •    Death or injury due to negligence
    •    Fraudulent misrepresentation; and
    •    Other liabilities that cannot be excluded neither limited by law
3.5 The liability of FirstPlus Care Limited resulting from a breach of these terms is limited to claims brought to us within a year from the time such breach initially came into occurrence.
4 Care Homes and Care Workers/Nurses
4.1 Under the T&C set forth hereby it is understood that:
4.1.1 That FirstPlus Care Limited does provide employment to any Care Worker/Nurse
4.1.2 These T&C in no case whatsoever does it refer to Care Workers/Nurses as our employee.
4.1.3 FirstPlus Care Limited does not recommend Care Workers/Nurses to Care Homes. Our responsibility is limited to those mentioned in clauses 4.2
4.1.4 FirstPlus Care Limited makes no warranty or representation regarding the suitability of a Care Worker/Nurse for employment to a Care Home.
4.1.5 FirstPlus Care Limited does not control any vacancies posted by Care Homes, neither do we influence or control what vacancy a Care Worker/Nurse applies to.
4.1.6 It is not our responsibility to assess the suitability, the qualification and the credentials of any Care Worker/Nurse applying for an employment offer from a Care Home on our platform. We do not ensure the suitability of the vacancy either. The responsibility lies with the Care Home (Client) and the Care Worker/Nurse to come into agreement under the terms of the relevant vacancy. The two parties involved, the Care Home and the Care Worker/Nurse directly agree upon any contract entered into, should it be contract for employment, services, or any other arrangement. Care Hires Limited does not take part in any arrangement or negotiation.
4.1.7 FirstPlus Care Limited does not supervise Care Workers/Nurses under the terms of any agreements, services, or assignment they have entered into.
4.1.8 FirstPlus Care Limited does not certify of the quality of services any Care Worker/Nurse may provide.
4.1.9 It is the responsibility of the Care Home (client) to request proper documentation, credentials, and/or qualification, and to assess whether the Care Worker/Nurse is suitable with reasonable experience for undertaking the employment, services, assignment, that the client has on offer as set forth under their terms of contract.
4.1.10 The responsibility lies with the client to ensure that the Worker/Nurse is in possession of adequate insurance for professional indemnity and public liability risks where such insurance is desirable.
4.1.11 CareHires Worker does resolve dispute resulting from the collaboration of the Care Home and the Care Worker/Nurse.
4.1.12 It's the responsibility of the Care Home to communicate with the Care Worker/Nurse with regards to any matters as underlined in clause 4.2 as well as under these T&C and any assignment.
4.2 The Care Home (client) acknowledge that we undertake the following actions with regards to the Care Worker(s)/Nurse(s)
4.2.1 We enter in contact with the Care Worker(s)/Nurse (s) in person and/or by telephone to determine whether they have the required experience and knowledge of the English language to undertake the vacancy, service, or assignment sought.
4.2.2 Obtain at least two references from previous employment of the Care Worker(s)/Nurse(s)
4.2.3 Verify the credentials, academic qualifications of the Care Worker(s)/Nurse(s)
4.2.4 Regarding registered nurses, we conduct checks on the NMC registration database for any restriction on practice – if there are any restriction, we will take the necessary steps to highlight such restrictions on the profile of the nurse(s) for visibility to the Care Home (client)
4.2.5 Verify the DBS certificates and the status online. If such certificate is not available online for update, any DBS certificate provided by the Care Worker(s)/Nurse(s) must be no more than 1 year old – Convictions found on the DBS will be highlighted for the attention of the Care Home(Client).
4.2.6 Obtain the necessary attestation from the Care Worker(s)/Nurse (s), that they have the necessary skills and competency for Care Work/ medical management and clinical competency.
4.2.7 Obtain the attestation from the Care Worker(s)/Nurse(s) to acquire as required by the MNC a professional indemnity insurance.
4.2.8 Perform the necessary verification for the right to work
4.2.9 The Care Home(Client) give their consent for the purpose of clarification that we use (if necessary) the services of a third party to undertake the verification(s) hereby stated.
4.3 Although we undertake the verifications as pointed out in clause 4.2 and update them at frequent intervals, it is the responsibility of the Care Home(s) to carry out the necessary verifications which includes but is not limited to the verification of the identity, the verification of the qualification, etc. regardless whether such verifications are mandatory by law or not.
4.4 Should for any reason the Care Home (Client) find reasons for concern regarding a Care Worker/Nurse, the client should take appropriate action in accordance to their legal and regulatory obligations. The Care Home (Client) has the responsibility to inform FirstPlus Care Limited of any concern or allegations regarding a Care Worker/Nurse.


5 Care Homes Responsibilities
5.1 The Care Home/Client hereby agree that by using this platform to post their vacancy, the client agrees for any Care Worker/Nurse to search for such vacancy and apply accordingly.
5.2 Your use of this platform implies that you warrant FirstPlus Care Limited to the following:
5.2.1 You will provide a genuine profile, that is truthful and accurate reflecting your personal details and your activities.
5.2.2 Any vacancy posted on this website are real, accurate, and truthful and will include; the specific vacancy, the job specification, the location, the payment terms, and the duration of the vacancy (daily, weekly, hour of work).
5.2.3 With regards to clause 5.2.2, you will indicate the type of experience sought and if necessary the qualification(s)
5.3 You warrant that any vacancy that you post on this website will under no circumstance directly or indirectly be a concern violating the anti-discrimination laws in force in the United Kingdom as underlined in the Equality Act 2010. The description of vacancy will under no circumstances be a concern of discrimination on the grounds of race, gender, or disability, or any other lawful matter that fall under such category.
5.4 If for any reason you have concern about the profile, qualification, and/or experience of a particular Care Worker (s)/Nurse (s) as indicated on our website. It is your responsibility to notify us accordingly regarding such concern in writing once such matter comes to your attention.
5.5 Your use of this platform may require that you leave feedback about your experience with a Care Worker (s)/Nurse(s) with whom you have collaborated for a job vacancy (assignment). This will may involve rating on our rating system.
5.6 You acknowledge that any Care Worker(s)/Nurse(s) may also provide feedback regarding their collaboration with you regarding a particular vacancy (assignment)
5.7 FirstPlus Care Limited is not responsible for any payment you may have as an obligation for the services rendered to you by a Care Worker(s)/Nurse(s). We simply facilitate such payments through our payment processing facility.
5.8 You acknowledge that your timeliness of payment for the time sheets of Care Worker(s)/Nurse(s) will be visible on your profile and on the profile of the Care Worker(s)/Nurse(s)
5.9 The payment processing facility necessitate that we conduct the Know Your Client/Anti Money Laundering verifications. As such, you acknowledge that for the purpose of processing payment you agree to provide the following information (Full identity (e.g. passport, driving licence), Name, Date of Birth, Nationality, Country of Residence, Address)
5.10 If you're acting as a company the Know Your Client/Anti Money Laundering requires the following information apart from the name and identity of the person making the request (the company number, the registration address, share holder agreements (if any), article of association, incorporation certificate)
5.11 Any job vacancy you post should include the following information;
5.11.1 The address where the job (assignment) is to be undertaken by the Care Worker(s)/Nurse(s)
5.11.2 The date and time the vacancy (assignment) starts and the duration
5.11.3 The paid or unpaid break hours allowed
5.11.4 The job (assignment) specification relating any experience, qualification, and/or training you desire the applicant Care Worker(s)/Nurse(s) to have regardless whether such credentials, skills are mandatory by law or by any professional body for the practice of the job (assignment) being offered.
5.12 You warrant and acknowledge to us that you are not acting on behalf of an employment agency, nor are you a locum or other agency.
5.13 When you come into agreement with a Care Worker(s)/Nurse(s) regarding a particular job (assignment), you acknowledge that you will:
5.13.1 Undertake the necessary risk assessment involving the job (assessment) and notify the Care Worker(s)/Nurse(s) of any such risk
5.13.2 Provide all necessary information to the Care Worker(s)/Nurse(s) about rules and regulations in force for undertaking the job (assignment) and the location the job (assessment) is located. This include rules regarding health and safety measures, security policy, information technology (IT) system, confidentiality, and any other rules, regulations deemed relevant for the job (assessment).
5.13.3 It's your responsibility to verify and review the Care Worker(s)/Nurse(s) time sheet for the days and hours worked. You are also responsible for approving any time sheet keeping in mind that the timeliness of a Care Worker(s)/Nurse will be reflected on his/her profile page on this website. 

6 Payment processing
6.1 Once you've approved a time sheet, the cost and payment details are to be computed on FirstPlus Care Limited invoicing procedure
6.2 In accordance with the agree time sheet, an invoice shall be generated on a weekly basis and issued to the Care Home (Client) and will include:
6.2.1. The total amount payable to the Care Worker(s)/Nurse(s) under the terms of the agreements of the job (assessment) being undertaken.
6.2.2. The relevant FirstPlus Care Limited charge agreed upon under these T & C for membership and use of FirstPlus Care Limited platform for the purpose of finding and hiring Care Worker(s)/Nurse(s), for temporary/permanent job or assignments
6.3 The Care Home(s) agree to pay the membership fees and any other fees such as job (assignment) fees either in the payment procedure e-wallet or in any other manner agreed upon with FirstPlus Care Limited.
6.4 The Care Home (Client) acknowledge that they will ensure availability of the necessary funds in their e-wallet on the present platform payment processing page, and that the funds should include:
6.4.1 The fees allocated to the Care Worker(s)/Nurse(s)
6.4.2 The fees allocated to FirstPlus Care Limited which include the membership fees (if applicable) and/or the percentage of the applicable hourly rate/wage payable to the Care Worker(s)/Nurse(s) as agreed upon under the terms of this T&C
6.5 FirstPlus Care Limited does not at any time have access to funds held on a Care Home (Client) e-wallet account

7 Care Worker(s)/Nurse(s) Responsibilities
7.1 The Care Worker(s)/Nurse agrees and acknowledges that:
7.1.1 FirstPlus Care Limited does not provide employment or assignment to any Care Worker(s)/Nurse(s)
7.1.2 These Terms and Conditions are under no circumstances an expression of an employment or assignment offer to a Care Worker(s)/Nurse(s)
7.1.3 FirstPlus Care Limited does not recommend and/or suggest a particular vacancy or Care Home to a Worker(s)/Nurse(s)
7.1.4 Under no circumstances does FirstPlus Care Limited make a representation or a warranty that a Care Worker(s)/Nurses is adequate for a particular vacancy (assignment)
7.1.5 FirstPlus Care Limited does not influence a Care Worker(s)/Nurse(s) in their choice of available vacancies. The Care Worker(s)/Nurse may apply to any vacancy he/she finds on our platform.
7.1.6 It is not mandatory that we perform the necessary verifications regarding an job posting by a Care Home(s) on our website. Neither to acknowledge the suitability of a Care Worker(s)/Nurse(s) for a particular vacancy. Both, the Care Home(s) and Care Worker(s)/Nurse(s) should communicate with each other and enter into agreement for a particular job (assignment). FirstPlus Care Limited doesn't enter into or play a role in the direct negotiations and agreement for a particular vacancy.
7.1.7 Should a Care Worker(s)/Nurse obtain a job/assignment offered by a Care Home. FirstPlus Care Limited doesn't supervise their activities for the job (assignment). Neither are we responsible regarding the quality of service offered by the Care Worker(s)/Nurse.
7.1.8 It is the right of a Care Home (s) to request documentary evidence to a Care Worker(s)/Nurse to assess their suitability for the available vacancy.
7.1.9 Care Homes Hire does not play a part in dispute resolution between the Care Home(s)(Client) and the Care Worker(s)/Nurse(s)
7.1.10 Either one of the two parties, the Care Home (client) or the Care Worker(s)/Nurse should enter into communication with the other party to resolve any issues involving disputes and/or obligations as set forth herein on the Terms and Conditions as well as applicable job(s)/assignment(s).
7.2 Should for any reason a Care Home (s) find reason of concern regarding the conduct and practices of a particular Care Worker(s)/Nurse(s). The Care Home (Client) if unable to resolve the issues directly should escalate the matter either through legal means and/or through the appropriate professional body of which the Care Worker(s)/Nurse may be a member of mandatory or not like for instance the NMC. It is mandatory for the Care Home (Client) to keep FirstPlus Care Limited informed of any issues, disputes, or any other cases of concern, investigations, etc. of which a Care Worker(s)/Nurse, member of the platform, may be subject to. 

8 Duties of Care Worker(s)/Nurse(s)
8.1 The Worker(s)/Nurse(s) about to embark in an employment (assignment) (temporary or permanent) on our platform should conduct the necessary research to identify the identity of a Care Home (Client). He/She needs to obtain all information necessary regarding the employment (assign). This includes but is not limited to the starting date, the location, the wage (hourly rate), the experience requirements, the desired qualification and/or training, as well as any health and safety risks concerned. The Care Worker(s)/Nurse(s) is also responsible to show as evidence such credentials as requested by the Care Home(s) and/or which are mandatory by law for the vacancy sought.
8.2 The Care Worker(s)/Nurse(s) is the only person responsible for application He/She submits for a vacancy to a Care Home(s) and to follow-up the progress of the application and/or undertake any discussions or agreements that may result during the hiring procedure of the Care Home(Client)
8.3 The Care Worker(s)/Nurse(s) acknowledge that FirstPlus Care Limited doesn't take part in any discussions, arrangements, or agreements that you (The Care Worker(s)/Nurse(s)) may enter into with the Care Home (Client).
8.3 It is the Care Worker(s)/Nurse(s) responsibility to submit via this platform, a time sheet, to the Care Home (Client) for any job (assignment) He/She may have undertaken. The time sheet should be submitted for the Care Home (Client) to acknowledge the job (assignment), therefore have the obligation to remunerate you for the job (assessment) performed.
8.4 You acknowledge that FirstPlus Care Limited is not responsible for providing the payment for any job (assessment) you may have done for a Care Home (Client). Our responsibility is strictly limited to facilitating the payment through our payment processing platform or e-wallet on your personal page.
8.5 Your use of our platform for applying and obtaining jobs (assignments) available on the platform of Care Homes (Clients) necessitate that you register. It is your responsibility to provide truthful and verifiable profile to increase your chances of acquiring a job (assignment). Information we ask on your profile include but is not limited to: your personal details, employment history, experience, qualifications, the right to work, and any other information relevant to further your professional career or that you may include in a job application.
8.6 You acknowledge that any information you provide on your profile is truthful to the best of your knowledge and that you will not under any circumstances provide misleading or falsified information.
8.7 You have the responsibility to update your profile accordingly when the need arises.
8.9 You acknowledge that you will comply with the Terms and Conditions as mentioned hereby for uploading documents, files, and/or any other materials relevant for your job application and of which is intended for attention of Hiring Care Homes (Clients) in general or a job application (vacancy) in particular.
8.10 You warrant that failure to comply with the conditions noted in clauses 8.6, 8.7, and 8.9 implies a breach of these Terms and Conditions in which case you will be liable to us and indemnify us for any loss or damage that we may incur because of your negligence that include but is not limited to, the loss of trust from our partner, the loss of business, and/or the loss of income.
8.11 You acknowledge and give us the right to reveal your details to any third party with which we collaborate and who claims content you've uploaded is in violation of their intellectual property and/or right of privacy.
8.12 If for any reason we have reason to believe that information you have provided is misleading and/or falsified, we reserve the right to delete such information.
Your use of this platform and the registration of your profile implies consent that we and any Home Care (Client) you send a job application may access your profile and make the necessary verifications for the truthfulness and accuracy of the information you've provided. Such verification may include sending your details to agencies such as the DBS, the MNC or any other third party who may conduct on our behalf such verifications.
8.13 You consent to leave feedback regarding any experience you have with a particular Care Home (Client) after having completed a job (assignment) with them.
8.14 You agree to inform us should for any reason you suspect that a Care Home (Client) has posted false or misleading information either regarding their profile and/or a vacancy.
8.15 You understand that your dealing with a Care Home (Client) will result the Care Home (Client) to also post a profile on your page regarding their experience of providing you a job (assignment).
9 Care Worker(s)/Nurse employment (assignment) concerns.
9.1 The duty of a Care Worker(s)/Nurse is of providing care (assistance) either in a residential home or a care home to vulnerable individuals to the extent of their expertise. The Care Worker(s)/Nurse(s) should undertake their assignment with due diligence and in accordance to the guidelines provided by professional bodies for Care Worker(s)/Nurse(s) such as the NMC.
9.2 If for any reason the Care Worker(s)/Nurse have safeguarding concerns against the manager or staff member where they have been assigned for duty. FirstPlus Care Limited will direct the Care Worker(s)/Nurse to the Guidance for nurses and midwives published by the NMC. The raising concern guidance of the MNC include information about the applicability and legislation that protects whistle-blowers and other advices for Care Worker(s)/Nurse(s) regarding such situation.
9.3 In case of any emergency while undertaking the job (assignment), Care Hires Limited suggest the Care Worker(s)/Nurse(s) contact the emergency services.


10 FirstPlus Care Limited reserves the right to add/delete/modify without notice any part of this Terms and Conditions.
The new changes will take effect on the date of its publication and made aware to the user(s), registered members either Care Home (Client) or Care Worker(s)/Nurse(s) by an update statement at the top of the page. Your continued use of the website after such update, changes means that you remain legally bound by the T&C and will abide by it.
